DŪFLAMBÉ actively enforces its intellectual property rights and distribution policies and may pursue legal remedies against unauthorized sellers, counterfeit distributors, or parties misrepresenting DŪFLAMBÉ products.
Brand Protection & Intellectual Property Notice
DŪFLAMBÉ is a protected luxury lifestyle brand. All DŪFLAMBÉ products, product designs, brand identity, trademarks, logos, product names, photography, marketing materials, product descriptions, and associated brand elements are the exclusive intellectual property of DŪFLAMBÉ.
Unauthorized use, reproduction, distribution, marketing, or misrepresentation of DŪFLAMBÉ products or brand assets is strictly prohibited.
No individual or entity may represent DŪFLAMBÉ products as their own brand, create derivative products using the DŪFLAMBÉ brand identity, falsely claim ownership of DŪFLAMBÉ products, or imply affiliation, partnership, or authorization from DŪFLAMBÉ without express written consent.
Any attempt to market, sell, distribute, or advertise DŪFLAMBÉ products as originating from another brand, business, or manufacturer may constitute trademark infringement, false designation of origin, unfair competition, intellectual property infringement, or other violations of applicable law.
Brand Enforcement & Anti-Counterfeit Protection
DŪFLAMBÉ actively monitors online marketplaces, social media platforms, ecommerce sites, and distribution channels for unauthorized resale activity, counterfeit products, intellectual property infringement, brand misrepresentation, and gray market distribution.
The company reserves the right to investigate and pursue enforcement actions against any individual or entity engaged in such conduct.
Enforcement actions may include but are not limited to:
• issuing cease-and-desist notices
• reporting violations to marketplace platforms
• requesting removal of infringing listings
• restricting purchases from violators
• pursuing intellectual property infringement claims
• pursuing civil remedies permitted under applicable law
DŪFLAMBÉ reserves the right to pursue all remedies available at law or in equity to protect its brand, intellectual property, and product identity.
Scope of Policy
This Authorized Retailer, Distribution & Anti-Resale Policy governs the authorized sale, distribution, and resale of all DŪFLAMBÉ products.
This policy applies to all products including but not limited to:
• luxury candle décor
• statement centerpiece candles
• sculptural wax décor
• clothing and apparel
• robes, kimonos, and garments
• bath and body products
• fragrances
• accessories
• decorative vessels
• gift cards
• limited edition releases
• custom products
• future product categories introduced by the brand
Retroactive Applicability
This policy applies retroactively and prospectively to all DŪFLAMBÉ products sold, distributed, gifted, or otherwise provided from the inception of the business on November 11, 2022, through the present date and into the future.
This policy applies to:
• all past product purchases
• all current product purchases
• all future product purchases
• all resale and distribution activities involving DŪFLAMBÉ products
This includes products sold through:
• the official website at DUFLAMBE.com
• social media storefronts
• direct-to-consumer sales channels
• promotional or event-based sales
• authorized retail partners
Authorized Retailers
DŪFLAMBÉ products are intended to be sold exclusively through official brand channels or retailers expressly authorized by DŪFLAMBÉ.
Authorized sales channels include:
• the official DŪFLAMBÉ website
• retail partners expressly authorized in writing by DŪFLAMBÉ
Any seller not expressly authorized by DŪFLAMBÉ is considered an unauthorized reseller.
Unauthorized Resale
Commercial resale of DŪFLAMBÉ products without express written authorization from DŪFLAMBÉ is prohibited.
Unauthorized resellers may not:
• sell DŪFLAMBÉ products for commercial purposes

Gray Market Distribution
Gray market distribution refers to the sale of authentic products through unauthorized distribution channels outside of approved DŪFLAMBÉ sales channels.
Gray market activity may result in:
• compromised product storage conditions
• altered packaging
• missing safety instructions
• incomplete product components
• misrepresentation of product origin
DŪFLAMBÉ does not guarantee the authenticity, safety, or condition of products obtained through unauthorized sellers.
Marketplace Restrictions
DŪFLAMBÉ products may not be sold on online marketplaces without prior written authorization.
Unauthorized marketplace sales include but are not limited to:
• Amazon
• eBay
• Etsy
• Walmart Marketplace
• Facebook Marketplace
• Poshmark
• Mercari
• Depop
• other resale or auction platforms
Unauthorized listings may be reported and removed where permitted by platform policies.
Brand Bidding & Advertising Restrictions
Unauthorized sellers may not use DŪFLAMBÉ trademarks or brand identifiers in connection with search engine marketing, keyword bidding, paid advertising campaigns, or sponsored listings.
This includes but is not limited to advertising through:
• Google Ads
• Bing Ads
• Meta advertising platforms
• TikTok advertising platforms
• marketplace advertising systems
Product Integrity Protection
Unauthorized resellers may not:
• alter product packaging
• remove safety labels or instructions
• modify product composition
• bundle products with unrelated goods
• repackage products for resale
• sell used products as new
Such activities may violate intellectual property laws and consumer protection regulations.
Brand Reputation Protection
DŪFLAMBÉ products may not be marketed, displayed, or sold in environments that damage or diminish the reputation, exclusivity, or brand positioning of DŪFLAMBÉ.
Brand Dilution Protection
Any use of the DŪFLAMBÉ brand in a manner that dilutes, tarnishes, or harms the distinctiveness of the brand may constitute trademark dilution under applicable law.
Catalog Scraping & Content Reproduction
Automated scraping, copying, or reproduction of product catalog information from DUFLAMBE.com is prohibited.
This includes copying:
• product descriptions
• product photography
• pricing information
• catalog structure
Product Warranty Limitations
Products purchased from unauthorized sellers are not eligible for:
• customer support services
• warranty coverage
• authenticity verification
• product replacement programs
DŪFLAMBÉ assumes no responsibility for products obtained through unauthorized sources.
Limitation of Liability
DŪFLAMBÉ shall not be responsible for the safety, quality, authenticity, or condition of products purchased through unauthorized sellers or distribution channels.
